Who We Are

The Lunar Foundation (TLF) is a Central Texas 501(c)(3) nonprofit organization (EIN: 93-4154707) dedicated to building economic pathways for Asian American, Native Hawaiian, and Pacific Islander (AANHPI) artists. Our mailing address is 5708 Sandhurst Cir., Austin, TX 78723.

This Privacy Policy explains how TLF collects, uses, and protects personal information across our programs and platforms, including the Austin Creates Together survey, the TLF Event Passport app, and our general organizational activities. By participating in any TLF program or using any TLF platform, you agree to the practices described here.

Information We Collect

TLF collects personal information only when you actively provide it through one of the following contexts.

Website and mailing list. When you sign up for TLF's newsletter or contact us through our website, we collect your name, email address, and any message you send. We use this to communicate about our programs and events.

Event attendance. When you register for or attend a TLF event, we may collect your name, email address, and event-related preferences. We also operate photo and video documentation at events; notice is provided on-site at each event.

Research and survey programs. When you participate in a TLF-sponsored research survey, information is collected as described in the Research and Survey Programs section below.

TLF Event Passport app. When you use the Event Passport app, information is collected as described in the TLF Event Passport App section below.

Donors and supporters. When you make a donation or submit a sponsorship inquiry, we collect your name, contact information, and payment details as needed to process the gift and fulfill any acknowledgment obligations. Payment processing is handled by third-party processors; TLF does not store full payment card numbers.

We do not collect personal information through cookies, tracking pixels, or passive analytics on our website beyond what standard web hosting platforms log automatically.

How We Use Your Information

TLF uses the personal information we collect for the following purposes.

  • To operate and improve our programs, events, and platforms

  • To communicate with you about TLF activities, opportunities, and updates you have opted into

  • To fulfill donor acknowledgment and grant reporting obligations

  • To conduct or support research that advances our mission, in accordance with any applicable data-sharing agreements

  • To administer incentive programs, such as the NightMarket.fun Passport point system

  • To comply with applicable law and our obligations as a 501(c)(3) nonprofit

We do not use your information for automated decision-making or profiling, and we do not sell, rent, or exchange your personal information with third parties for marketing purposes.

Research and Survey Programs

TLF commissions research surveys in partnership with third-party research firms to better understand the AANHPI artist community and arts ecosystem in Central Texas. This section describes how those programs work.

Austin Creates Together (ACT) Survey. The ACT Survey is a research study commissioned by TLF and conducted by Nielsen Data for Good. Nielsen designs, hosts, and administers the survey instrument. All survey responses are collected anonymously by Nielsen. TLF does not receive individual respondent-level data. Nielsen delivers aggregated, de-identified analysis to TLF approximately six weeks after the survey collection window closes.

Survey participation is entirely voluntary. The survey asks about demographic information, including racial and ethnic identity, which may be considered sensitive under certain U.S. state privacy laws. Nielsen's own privacy notice, which governs how survey data is handled by Nielsen, is available at nielsen.com/legal/nielsen-survey-privacy-notice.

If you complete the ACT Survey and choose to enter a prize or incentive program associated with it, that program is administered separately by TLF and is not connected to your survey responses. Any contact information you provide for incentive entry is collected by TLF, not Nielsen, and is governed by this Privacy Policy.

TLF Event Passport App

The TLF Event Passport is a web-based event guide app that TLF operates at select events. The app gamifies event engagement by allowing attendees to earn points by visiting booths, completing activities, and entering passcodes. Points can be redeemed for prizes at an on-site prize booth.

What the app collects. To use the Event Passport app, you may create an account or access the app through a guest session. Information collected may include your name or display name, email address (if you create an account), and your in-app activity, including QR code scans, passcodes entered, and points accumulated.

How we use it. We use Event Passport app data to operate the points and prize system, verify prize eligibility at the event, and improve the app experience at future events. We do not use Event Passport app data to contact you after the event unless you have separately opted into TLF communications.

Passcodes from survey completion. If you complete the Austin Creates Together survey and receive a passcode to enter into the Event Passport app for points, entering that passcode does not connect your survey responses to your app account. The passcode is a one-way mechanism; Nielsen does not receive any information about your Event Passport app activity, and TLF does not learn which specific survey responses are associated with which passcode entries.

Data retention. Event Passport app account data and activity logs are retained for up to 12 months after the event, after which they are deleted or anonymized.

Information Sharing

TLF does not sell, rent, or trade your personal information. We share information only in the following limited circumstances.

Service providers. We work with third-party vendors who help us operate our programs and platforms, such as email newsletter platforms, event registration tools, payment processors, and app hosting services. These vendors are permitted to use your information only to provide services to TLF and are required to protect it appropriately.

Research partners. When TLF commissions a survey or research study, the research firm (such as Nielsen) operates under a separate data agreement. As described in the Research and Survey Programs section, TLF receives only aggregated, de-identified findings -- not individual-level data -- from those studies.

Legal compliance. We may disclose personal information if required to do so by law, or in response to a valid legal process such as a subpoena or court order.

Organizational transitions. If TLF merges with, is acquired by, or transfers its programs to another organization, personal information may be transferred as part of that transition. We will provide notice of any such change.

We do not share your information with sponsors, funders, or partner organizations for their own marketing or outreach purposes without your explicit consent.

Your Rights and Choices

We respect your ability to make informed choices about your personal information. Depending on where you live, you may have certain rights under applicable privacy law, including the Texas Data Privacy and Security Act.

You may request that we provide you with a copy of the personal information we hold about you, correct any information that is inaccurate or incomplete, or delete personal information we hold about you, subject to limited exceptions where retention is required by law or legitimate organizational interest. You may also opt out of receiving marketing communications from us at any time by clicking the unsubscribe link in any email or contacting us directly.

To exercise any of these rights, please contact us using the information in the section below. We will respond to verifiable requests within a reasonable timeframe and in accordance with applicable law. We will not discriminate against you for exercising your rights.

For information collected through the ACT Survey, please note that TLF receives only aggregated, de-identified research findings from Nielsen. Individual survey responses remain with Nielsen and are subject to Nielsen's own privacy practices. To exercise rights related to that data, contact Nielsen directly using the information provided at nielsen.com/legal/nielsen-survey-privacy-notice/.

For TLF Event Passport app participants, you may request deletion of your account and associated data by contacting us at the address below. Account data is retained for up to 12 months after the event and then deleted or anonymized.

If you believe your privacy rights have not been honored, you have the right to file a complaint with the Texas Attorney General or another applicable regulatory authority.
